CANDEY CAPITAL (BVI) Limited - Launch of Litigation Corporate Finance Fund
CANDEY have launched a litigation corporate finance fund to fight claims arising from insolvencies and distressed situations. Working with and on behalf of insolvency practitioners the fund will operate out of the BVI where CANDEY established an office in Summer 2024.
The fund seeks to capitalise on the global cross-border nature of modern litigation, instructing teams in London, BVI, New York and Asia Pacific.
With recent hires, Andrew Child (Head of Trusts & Estates Disputes) and Chris Bailey Asia based (Global Head of Energy & Infrastructure), CANDEY has a complete offshore contentious offering with its insolvency, company commercial and international arbitration practices.
The fund seeks to take assignments of assignable claims from liquidators and bankruptcy trustees where funding is an issue. We intend to use our own capital and also co-fund with funders.
The intent is for the fund to use CANDEY solicitors, barristers and attorneys in the US, BVI, UK, and Asia to litigate meritorious claims and remove costs, adverse costs and risk from the shoulders of insolvency practitioners.
The fund is run independently of CANDEY and it’s London management team. It provides liquidators with a percentage on any recovery without any cost and risk.
CANDEY has funded litigation for 15 years via DBAs and CFAs: this is a step towards working in closer partnership with insolvency practitioners and their paid and unpaid lawyers based globally.
The fund will be led by David Harby in the BVI and Chris Bailey in Singapore.
